A 20-year-old man from Texas has been charged with attempted murder and arson after allegedly attacking the home of OpenAI CEO Sam Altman with a Molotov cocktail, according to San Francisco District Attorney Brooke Jenkins. The incident occurred on Friday morning in San Francisco, and authorities say the suspect also targeted OpenAI’s headquarters later that day.
Charges and Legal Proceedings
Daniel Moreno-Gama faces two counts of attempted murder and nine other charges following the attack on Altman’s home in San Francisco, according to Jenkins; the charges were announced at a news conference on Monday, where she emphasized the seriousness of the case.
Moreno-Gama is also separately facing federal charges of attempted damage and destruction of property by means of explosives, and possession of an unregistered firearm. According to an FBI affidavit. He was captured on a security camera hurling an incendiary device at Altman’s home shortly after 3:30 a.m. local time on Friday.
Following the attack on Altman’s home, Moreno-Gama traveled to OpenAI’s San Francisco headquarters, where he struck the building’s glass doors with a chair and stated his intention to “burn it down and kill anyone inside,” according to the affidavit filed in US District Court for the Northern District of California.
After arresting Moreno-Gama at the scene, police recovered incendiary devices, a container of kerosene, a lighter, and a document espousing opposition to artificial intelligence and tech executives, including Altman, according to the affidavit. The document recovered at the scene stated that Moreno-Gama had killed or attempted to kill Altman, and that he “must lead by example and show that I am fully sincere in my message,” according to the filing.
OpenAI CEO’s Response to the Attack

We need to work through the democratic process,” the company said. “We welcome a good faith debate, but there is no place in our democracy for violence against anyone, regardless of the AI lab they work at or side of the debate they belong to.”
Legal and Political Reactions
San Francisco District Attorney Brooke Jenkins criticized what she described as “incendiary rhetoric” about the potential impact of AI on society. “In no way should we be at the point where a man could have lost his life over differences of opinion and concerns,” she said at a press conference on Monday.
Acting Attorney General Todd Blanche also commented on the case, stating that “violence cannot be the norm for expressing disagreement, be it with politics or a technology or any other matter.” He added that the alleged actions, which damaged property and could have taken lives, would be aggressively prosecuted.
Federal prosecutors allege that Moreno-Gama set fire to an exterior gate at Altman’s home around 4:00 local time on Friday before fleeing on foot. He is also accused of trying to set fire to the San Francisco headquarters of OpenAI, about an hour later. Security personnel on site stated that Moreno-Gama tried to use a chair to strike the glass doors of the building, according to the complaint.
The justice department said officers had recovered incendiary devices, a jug of kerosene, and a lighter from Moreno-Gama. The documents allegedly carried by Moreno-Gama discussed potential risks that AI poses to humanity, with a section titled: “Some more words on the matter of our impending extinction.”
The documents also allegedly stated, “if I am going to advocate for others to kill and commit crimes, then I must lead by example and show that I am fully sincere in my message,” and included the names and addresses of board members, CEOs, and investors at various AI companies.
