Chris Brown, a prominent R&B singer, avoided immediate jail time after being convicted of affray following an altercation at a London nightclub. The singer was handed an eight-month prison sentence, suspended for 12 months, at Southwark Crown Court. His vocal coach, rapper Omololu Akinlolu, who also participated in the attack, received a four-month suspended sentence, also for 12 months. Both were ordered to pay £1,500 in costs.

Details of the Attack

During the incident at the Tape nightclub in Mayfair on 19 February 2023, Brown struck the victim, music producer Abraham ‘Abe’ Diaw, twice in the head with a glass tequila bottle. The victim required hospital treatment for his injuries, including a high-grade ligament injury to his left knee, revealed in an MRI scan taken in early March. CCTV footage showed Brown hitting Diaw four times with the bottle, twice to the head, and once to the shoulder.

Judicial Ruling and Sentencing

During the sentencing, Judge Tony Baumgartner stated that the use of the glass bottle in such a manner was “plainly dangerous” and carried the risk of more serious injury. He emphasized that the law applies equally to all individuals, regardless of their fame or professional standing. The judge noted that the violence was “intense” and created a risk not only to the victim but also to others nearby.

Despite the severity of the attack, the judge concluded that the circumstances did not justify immediate imprisonment. This decision was influenced by recent changes to sentencing laws, which require suspended sentences unless there are exceptional reasons for immediate custodial sentences. The court heard that Brown and Akinlolu had pleaded guilty to the charge of affray and that Brown had a clean record since his last conviction in 2013.

Defense and Prosecution Perspectives

The defense described the incident as a “short and deeply regretted” event, emphasizing Brown’s dedication to his children and his law-abiding life since his last conviction. Brown’s lawyer, Sallie Bennett-Jenkins KC, apologized for the incident and described it as “ugly and unattractive” but brief, lasting no more than 20 seconds. The defense argued that the attack caused no fractures or broken skin and that the victim’s injuries were not as significant as the prosecution suggested.

The prosecution, represented by Heidi Stonecliffe KC, described the tequila bottle as a “heavy square-shaped” weapon and detailed how the victim was approached at around 03:00 and subjected to further kicks while on the floor. The victim, Diaw, was treated at St Mary’s Hospital and later discharged with pain relief and a diagnosis of a head injury and superficial knee injury. It was noted in court that Diaw was “not supportive of the prosecution” and had “withdrew” his support some time after the incident.

Following the sentencing, Brown was seen clapping hands with Akinlolu before exiting the court. Outside, there were loud cheers as he left the building. Brown also shared a video on his Instagram story, showing him giving a thumbs-up to the camera.
